Without knowing too much about the law I would say that the landowner (housing partnership) or occupier (yourselves) have a responsibility to keep the bushes in order if they are on your property such as cutting them back so that any path or road has free access.

If they are in an open space then whoever manages this area has a duty of care to keep them maintained.

Many people have grown up around thorny bushes and they have never been a problem. Better have them than not.

I don't think there is any health and safety legislation for these types of bushes, as the thorns are harmless unless you fall into them or deliberately go into them, unlike tree's which hcan become an issue if they are in danger of falling.

If there was would every rose have to carry a warning on it?

EDIT: Where my tax dollars are concerned, I don't care for the old adage "something is better than nothing," especially when that something will result in needless expansion of government and beauracracy with barely any benefit to most Americans.

I think H&S is responding to the ridiculous compensation culture which the UK seems to have adopted. Without the H&S rules the publicly run institutions are more susceptible to being sued for ridiculous reasons.

I'm not saying I agree with it though - some of the legislation is silly.

We Answered:

Because nobody connects the dots. It's like opposing abortion, but having no financial plan to deal with the 2-3 million unwanted children who are going to be born every year and dumped into the child welfare system. Nobody is thinking anything out. Ridiculous, isn't it?
