Neil Said:

If a parent has the child 50% of the time, do they still have to pay child support?

We Answered:

It depends on the financial ability of each parent. Personally, I'd suggest turning in the mother as an illegal to INS and taking full time custody of the child. Then you can pursue support payments from the mother when she returns to her country.

Is it disgraceful for a Dead BEAT Dad to walk the bride down the aisle when he hardly paid child support?

We Answered:

Which church says that he has to walk her? What if he were dead?! MY best friend got married at orthodox catholic wedding and she walked down the aisle with her mom because she wasn't close to her dad. He sat on the ceremony and that was it.

It is a disgrace to the mother and a total charade to the world.

My dad has always been there economically but that is it. He never ask how we are, he doesnt care. He feels he has fullfilled his duties as a dad by paying until we all turned 18. He and I have nothing in common and on my sister's wedding he gave a toast and called the groom "Thomas" he name is Timothy!!.

I am walking down with my mom who has sacrificed everything in her life to give us a better one. She is funny and is always there for me. And if the only way for me to marry was to walk down with my dad while my mom sits on the pews then I would either marry somewhere else or not marry. It is that important to me. Is a matter of principle and I wouldn't want to compromise my principles on such a happy day.

Flu Vaccine Discrimination?

We Answered:

You have several options:

1) You could go to other pediatrician (I'm sure that's not the only pediatrician in town).

2) You could wait until October

3) You could pay cash from your own pocket.

As for discrimination: No it's not. The law only recognize discrimination for race, sex, age, national origin and so on.

Coverage insurance is not a protected class so you can't claim discrimination laws.

Usually doctors reject certain insurances when they know that such company do not pay or that they pay way too late. So even if your insurance call and make a lot of "promises" your doctor can't be forced to trust them.

"What if the kids get the flu?" That would be bad luck but you wouldn't be able to sue anyone if that's what you want to know.

This is the kid of stuff that happens every day since we put our Health Care Systems in the hands of the Private Insurance Companies.

Mildred Said:

What do child support payments include?

We Answered:

Daycare can be an "extra" to child support. (I don't think occasional "babysitting" counts because that is for the parent's convenience and not a necessity in order to work).

Doctors visits: In NJ the custodial parent is responsible for the first $250 per year then their % of the total income of both parents. At the end of the year a calculation determines how much the non-custodial parent owes in refund and this is handled through court.

Dance classes: May be considered an "extra" in which the court can/will determine if the NCP should pay and how much.

If you have a drastic change in income then you absolutely can and SHOULD file for an adjustment with the court. If you two were married then your change in income would cause for an adjustment of family expenses, same goes for when you're separated.

I HATE women who take advantage of good men and leave a bad rep for the women like myself who are trying to do what is right. I spend way more that double the support amount on my daughter every month. I do nothing for myself. I encourage visitation and even bend over backwards (which I shouldn't) only to be called a money grubber by the man who needed to borrow gas money to get to court for the child support hearing (making $55k a year).

Please go through the courts and have them decide whether she should be getting more or less. It protects you as well. I know many men think there is a stigma of going to court to have the $$$ part of caring for a child settled but honestly: If you go through court then you both are held accountable and she can't take advantage of you (or you her, but it doesn't sound like the case here.)

Good luck and God Bless...
