No, you cannot obtain your mother's health records without her permission if she is living unless you have her power-of-attorney.

You say she is better. Have your tried talking to her about this? That's your first recourse. You can't get to them behind her back.

If the biological father still has parental rights then he is allowed access to the child's medical information under HIPAA.

The only way to prevent this would be for you to hire a lawyer who practices Family Law and try to terminate his parental rights; if he really is an abuser then that wouldn't be too difficult a case to make.

Yes.
Basically she's a health professional and can access your and your sons records.
She's probably not being nosey, just doing her job.
Every Tom Dick and Harry don't have access to your records only those with a legitimate reason to look at them.
Health visitors are a very important link between home and interested professionals.
If you have a complaint contact your local NHS Trust.

Do you have the name of the child? You might just be able to go to the county courthouse and request the birth certificate then since you have the mothers name.

Not really sure, but I would think if you have joint custody you have 100% of the rights as their mother. Do you know if she has access to these records? If so, the counselor is breaking the law by denying access to you as well. You will probably be able to obtain free legal advice on this. Any further steps by an attorney would be an expense, but it would be worth a try. Also, you can ask teh previous counselors if this is, in fact, a law. If not, I would let miss snooty counselor know that you know she is lying to you, and it would be in her best interest to let you have access to the records.

The thing is that adopted people ought to be treated EQUALLY to non adopted people, so they should have the same access to their own vital records as other citizens. The way adopted people are denied access to their vital records is discrimination, pure and simple.
