You cannot get reimbursed for medical insurance payments... however, you can be reimbursed for one-half of all vision, medical, orthodontia, prescription drug costs acquired on behalf of the minor children.

You can seek a court order for reimbursement... attach receipts... and you can seek a court order for him to include the children on his medical insurance if it is offered through his employer.

I'll address both parts of your question separately...

1) Your nephew's father would not need to obtain your sister's consent to add their son to a medical insurance policy.

2) Regarding the fraud...something sounds suspicious. If your nephew's father and this woman were still married, she may have been able to legitimately add him as a stepchild. However, since the woman is no longer married to the child's father and the child does not live with her, I can't think of any circumstance where he would be allowed to be on her policy.

If this woman were your nephew's stepmother, your sister's permission would not be needed to add him to the stepmother's insurance policy.

Since that's not the case, it does sounds like they are doing something fishy, and if her employer does a dependent eligibility audit, they will get caught. (In a dependent eligibility audit, you have to provide documentation to prove that the people you are claiming should legitimately be on the insurance policy. Examples - birth certificates, marriage certificates, etc.)

Each state's law mandates the maximum age at which a dependent child will be allowed to continue on their parents plan. Recent legislation in my state, CT, changed the age to 26, regardless of student status. Restrictions apply.

Since none of us have sufficient information to answer your question, I suggest you contact the HR department at your employer and ask them what the applicable age is for you and your family.

Not much. It depends on the age, health, and what state they live in. In my state and 'average' plan for a 1-17 year old is between $50-$150/month.
