He is responsible for the kids and making sure they are ok, so he has to at least keep sending the Child Support.
My suggestion would be why not try to get custody of them? The home life you could provide is much more stable and comfortable, and you could work it out that she doesn't have to send any type of support.

You may want to consider adoption so the child can have a chance to grow up in a loving stable home with two parents.

If you plan on keeping the child and raising him as a single mother, you know that the sperm donor will not be part of the baby's life.

You need to get the court involved. There may have to be a paternity test done and he will be ordered to pay support - it will be taken out of his pay check automatically as an allotment.

Your child will have Tricare health coverage - you also need to get the dental coverage for the baby - that is separate. Have the court order him to provide that as well.

Educate yourself about Tricare - they are a pain to deal with in the beginning, but once you have a doctor that is part of their network where you live, you will be ok.

Don't get stressed out, the state is not going to take your husband's child support. When you apply for Cash welfare benefits OR Medicaid for children, you are required to cooperate with that state's child support enforcement agency. When receiving Medicaid benefits only, the state will not keep the child support, but the child support agency may require the mom to pay the benefits through the state rather than directly to you. Also, the Child Support agencies can enforce medical support orders as well as cash child support orders. They may be wanting the mom's information to determine if she is in a position to provide medical benefits for the children.

If your school is still in session you need to talk to the school social worker ASAP. They can help you negotiate the complicated rules and tell you in your county and state how you access services.

It is different in every state so any advice I would give you would not be accurate for your state - so please contact the school district right away.

Now lets get some terms straight because using them the way you do makes it sound like you are trying to take advantage of the system. But you are leaving off the most important information.

You cannot be both 504 and IEP. You are one or the other. The IEP provides more services that 504 just some accommodations. If however all she has is an IEP and is as involved as you are saying - you must right away ask for a special education evaluation (put your request in writing) they will then do it when school starts.

What you need to know is what her 'setting is' in school - how much of her day is spent in special education support or services - typically it would range from 1 - little service - to 3 most of the day NOT with her typical peers. That setting tells anyone who may help you a lot.

You need to have a folder with the following:
- School evaluation & IEP
- Outside clinic notes, evaluations, etc
- historical information from MI

You would apply through County Social Services and they should be able to provide you assistance for Personal Care Attendant so you can get some respite or assistance. They should cover the cost of her outside Psych, they should also provide assistance with medication. These services are available for parents of children so would certainly be considered if you are a guardian.

Please contact your school Social Worker so they can help you care for your niece.
