I've been in commercial insurance for 28 years. While I am in NC and not NY, my clients are very large with, multi-state operations which include NY. I know NY very well.

Good news is it's very employee friendly but rapidly changing. You are in the window of avoiding any anti-employee changes as that will take years, if it ever happens. So, you are in the driver's seat.

The previous response was somewhat correct in that insurance companies do have "their" (these are good doctors and have nothing financially to do with insurance companies paying them money to issue statements that are anything but in your best interests) doctors to counter those claims that keep the case running for your attorney's to collect their 1/3 of the settlement. You read that right, getting an attorney that gets you a juicy $100,000 settlement will net you a check for $66,000. That $25,000 figure they throw at you in the beginning that sounds like enough to handle things OK, will only be 2/3rds of that amount to you. I'm just throwing out numbers for you to get an idea. I have no idea what your medical bills are, your medical condition or average weekly wages.

Now, you don't need an attorney if you feel you are being treated fairly by the insurance company. They can't make you return to work but, the doctors will, issue a notice if you can return to light duty with XXX restrictions. If you refuse, your employer (policies differ and I can't comment on yours) can terminate you for refusal to do so.

So we are back to square 1, what to do? Your company's insurance broker or agent isn't going to help you as an individual. Have you talked to your Human Resources people? If not, do so first. If so, and no response, you can respond to this message and I'll do what I can to help you through the process. No guarantees but I won't charge anything either.

Go to lawyer.com to search for one. This is a legitimate website, and it's free. Once you put all your info in, you will be given referrals to attorneys in your area. If you don't want to use the website, call the New York State Bar Association and ask them for referrals. This is a free service as well.
