The doctors contractual relationship is with the agency, and the agency's contractual relationship is with the hospital.
The agency is obligated to pay the doctors contractual pay (including notice) whether the hospital pay the agency or not.
You say the doctor is "supposed" to get 2 weeks notice: who says? where is that written and agreed? Is there no trial period?

The ET has no jurisdiction to hear any claim against the hospital by the doctor, not least because his employment is less than 12 months (not two years per the earlier answer).

I've been led to believe on a similar matter that whether or not the claim is 'out of time' is entirely a matter for the discretion of the Tribunal. As such, I would guess that the pre-hearing would be used to establish that. It sounds as if you have a reasonable case and a fair reason so what's the harm in a pre-hearing? I would make sure that your reasons for the delay and the fact that it was beyond your control are clearly set out and go through the pre-hearing, and, for want of a better description, throw yourself on the mercy of the 'court'.
