The only way he could be subpoenaed would be if the litigant from New York got a Georgia court to issue it. Most likely, they'd only want to depose him by phone. Besides, even if he is deposed, you can always seek a protective order to allow him to do the deposition in Georgia, or to appear telephonically or by video. Happens all the time.Now, if he's an expert witness, then he can expect having to appear and testify in person. And YOU can expect to have to pay him.
