Jimmie Said:
What would be the penalty for prescription fraud for a non-controlled substance? I work in Maryland.?We Answered:
There are a few layers to this.Technically speaking, the controlled substance criminal laws (§ 5-601 and § 5-606) on prescription fraud require that the drug requested is a "controlled dangerous substance," which by state law definition is anything in Schedule I-V, including precursors and chemical intermediaries. Because you did not name the drug, it is not possible for me to say if it falls within that category.
But, even if it doesn't fall within the definition of a controlled dangerous substance, it does fall within MD's laws on fraud. Specifically, there is a crime called § 8-610. "Counterfeiting prescription." This crime doesn't require that it be a controlled substance, but rather any drug or even alcohol. This is a misdemeanor and the sentence can be as high as 2 years in jail. That is the maximum though. If the judge is smart though, and her defense attorney presents compelling evidence, it may be possible for her to be sentenced to probation, fine and mandatory mental health treatment. As a psychologist, I sincerely hope for the later because I know how serious anorexia nervosa can be.
If you happened to know her name, you can check the progress of her case through the MD court system's website. http://casesearch.courts.state.md.us/inq…
