Carmen Said:

What to do about possible negligent ER care for stroke victim?

We Answered:

While I can't comment on whether the hospital was negligent, you are correct about immediate treatment for stroke. Medications such as thrombolytics must be given within three hours of the onset of the stroke. You should contact the administration at the hospital to file a grievance. If you don't get a satisfactory response, you should consider consulting with a lawyer.

Is the hospital required to provide a sitter?

We Answered:

Sitters are used to decrease dependency on restraints. Our hospital has adopted a policy to use sitters when possible as opposed to retstriants. Hospitals typically have this privlidge to provide sitters...they are usually PCTs or nurses who are on light duty and cannot perform heavy patient care.

The rehab unit is undoubtly a smaller institution and is not expected to have the same resources a hospital has.

There is no legal stipulation for providing a sitter. However, they should be taking appropriate measures to ensure his safety...bed alarms, a bed close to the nurses station, and if needed, restraints such as a posey vest or hand mittens.
