Have your child re-tested and get a second opinion. Make certain she has an IEP in place and a true diagnosis. Scream a lot. Ask a lot of questions. Demand a reevaluation.Make a total pest of yourself. It is unfortunate, but schools will try to do as little as they can get away with. It is early yet; she can still catch up. But you're going to have to be her advocate -- nobody is going to do it for you.

Some young children with speech delay are also classified as being on the mild end of the Autism Spectrum Disorder scale. If the eligibility of "autism" exists, then SSI eligibility is possible.

We Answered:

Parents have rights to challenge the IEP, a benefit of special education. Students without disabilities and their families lack the right to challenge curriculum decisions.

The answer is, you have every right to challenge this all the way up to the Federal level if you oppose this, including with lawyers who are specially trained in special education law.

It is not something which the school has the right to continue just doing--and merely because they are the school either.

When your son was first enrolled in special education, you should have been given a pamphlet/booklet outlining the procedure for the IEP, including what to do when you disagree with the initial outcome of a decision.

Also consider talking with the state education department's special education division for resources/referrals to community groups. And the US Department of Education provides free down-loadable brochures on its website about the legal rights of students with disabilities and their parents, including the general process for challenging an IEP decision.
